Park Homes: New Work for RPTS from next April

The Government announced on 16 December that subject to Parliamentary approval a number of jurisdictions relating to park homes will transfer to RPTS from the courts with effect from 6 April 2010. The transfer follows wide ranging public consultations by Communities & Local Government.
There was strong support for the transfer in the consultation. The cases that it is proposed to transfer to RPTS comprise those that concern
- residents’ right to have a written statement
- refusals to approve the sale of a home
- the gift of a home
- the re-siting of park homes
- pitch fee reviews
- the recognition of residents’ associations
- matters that may be implied into an agreement under Part II of schedule 1 to the Act
- the varying or deletion of an express term
Commenting on the new work, Siobhan McGrath, Senior President of RPTS, said
"We are very pleased to take on these new jurisdictions. I am sure the settlement of disputes in these areas will benefit from our expert tribunal membership. We have expanded the scope of our work considerably over the last six years, and the addition of park homes cases fits well with our aim to offer a comprehensive and accessible housing tribunal service."
